State Regulation of Unauthorized Practice of Law in Arbitration and Mediation by Barry Temkin, published in the August 2010 BNA Securities Regulation & Law Report

MCWG Counsel Barry Temkin has published an article in the August 16, 2010 BNA Securities Regulation & Law Report entitled "State Regulation of Unauthorized Practice of Law in Arbitration and Mediation."  In his article, Mr. Temkin, who teaches professional responsibility at Fordham University School of Law, discusses under what circumstances a lawyer admitted to practice in one jurisdiction may ethically appear in an arbitration venued in another jurisdiction.  Surprisingly, New York, in a recent revision to its Rules of Professional Conduct, rejected a proposal by the American Bar Association which would have facilitated arbitration and mediation appearances by out of state practitioners.  For more information, contact Barry Temkin at btemkin@moundcotton.com.
