Danner, Paul S.

Paul S. Danner concentrates his practice on the litigation of products liability and toxic tort cases, including exposure to chemicals, lead, mold and asbestos. He is retained as dedicated New Jersey counsel for a Fortune 500 company defending benzene exposure cases. He also handles serious construction accidents matters involving personal injury, property damage and associated contractual disputes. He routinely handles catastrophic personal injury cases, including wrongful death. In addition, Mr. Danner handles pharmaceutical litigation for a major generic drug manufacturer as well as general commercial and contractual disputes for other clients. He also counsels insurance clients on first- and third-party coverage matters.
Prior to joining the firm, Mr. Danner was a judicial law clerk for Judge Kenneth R. Stein and Presiding Chancery Judge R. Benjamin Cohen of the Superior Court of New Jersey, Essex County, New Jersey. Mr. Danner, who litigates cases in state and federal courts at both the trial and appellate levels, is admitted to the New York and New Jersey bars, as well as the Federal District Courts of New Jersey, the Eastern District of New York and the Southern District of New York as well as the Third Circuit Court of Appeals.
Mr. Danner received his J.D. in 1999 from Rutgers-Newark School of Law and graduated from Rutgers College in 1996.

RECENT DECISIONS OF NOTE:
- Diaz v. Morey Larue et al, Docket No. ESX-L-8705-09 (N.J. Law Div. Mar. 2, 2012) – obtained summary judgment on statute of limitations grounds, i.e., inapplicability of fictitious defendant and discovery rules, on behalf of client who was a landlord and former commercial laundry operator in wrongful death case arising out of workplace chemical inhalation incident.
- Bolanos v. Pulte Construction, et al, Docket No. ESX-L-1226-07 (N.J. Law Div. Feb. 9, 2012) – obtained summary judgment on behalf of client, a construction contractor, who was plaintiff’s employer. Defendant/Third-Party Plaintiff sought common and contractual indemnification from the client contending that it was responsible for plaintiff’s fall from a first floor balcony.
- Lam v. 39 CAM LLC, et al, Index No. 104386-06 (N.Y. Sup. Ct. Dec. 20, 2011) – procured summary judgment on behalf of client, commercial landlord, in case involving alleged serious elevator incident. Court held, among other things, that there was no evidence client had notice of any problem(s) with the elevator.
- Wolf v. Bob Marriot’s Flyfishing Store, et al, Civ. Action No. 10-2860 (JHR-JS) (D.N.J. Nov. 28, 2011) – co-lead counsel who obtained summary judgment dismissing wrongful death case arising out of boating accident in Costa Rica on behalf of client, travel agent. Court granted motion based in part upon statute of limitations, Death on the High Seas Act and a lack of evidence that client acted unreasonably.
